REDEVELOPMENT

The Turteltaub Law Firm represents developers, property owners and municipalities in connection with all aspects of New Jersey’s redevelopment laws including the:

  • Study of properties to determine whether they satisfy the criteria for designation of as an area in need of redevelopment;

  • Drafting of redevelopment plans;

  • Drafting and negotiation of redevelopment agreements;

  • Acquisition of properties necessary for a redevelopment project;

  • Preparation of applications for site plan and other governmental approvals;

  • Presentation of applications to the appropriate governmental authorities for approval, and

  • Litigation of matters arising out of the redevelopment process.

LAND USE

The Turteltaub Law Firm works with clients in all aspects of land use law such including the process of obtaining the approvals to develop or modify properties. In doing so, we use our experience to provide our clients with legal advice and business strategies to navigate through the complicated land use approval process. During the course of our representation, we work closely with our clients and their experts and consultants to:

  • Review zoning ordinances and other land use controls;

  • Develop strategies to formulate viable project plans;

  • Review the many issues that impact site plans such as environmental constraints, traffic impacts, operations issues, title and surveys, neighborhood impacts, and required variance relief or zoning modifications.

  • File the requisite applications with the governmental authorities;

  • Present the applications to the appropriate governmental authorities, and

  • Litigate matters arising out of the land use process.

EMINENT DOMAIN

The Turteltaub Law Firm works with property owners, municipalities and, in the case of redevelopment, developers, in all aspects of the process by which government acquires property either through negotiation or the exercise of the power of eminent domain which is also referred to as the “condemnation” of property. In doing so, we assist clients in addressing the primary issues in every condemnation action:

  • Whether the governing body has the right to take the private property;

  • Whether the governing body has properly exercised its power of eminent domain; and

  • Determining the amount of the just compensation to be paid for the property being acquired by eminent domain.

We work with property owners and municipalities during all phases of the eminent domain
process including:

  • The authorization of the taking;

  • The evaluation of the property being acquired including title reviews, environmental assessments and the appraisal of just compensation;

  • The conduct of bona fide negotiations required by law and attempt to reach an agreement as to compensation for the taking without the need for litigation; and

  • If an agreement is not reached, eminent domain litigation to determine the right of the governing body to take the private property and to establish the appropriate amount of just compensation for the property owner.

In addition, we provide legal advice to Clients in addressing issues of environmental contamination on the condemned property that may be present or require investigation. As part of this effort, we assist in establishing the amount of any required environmental escrow that may need to be established from the just compensation to be paid for the property.

PURCHASE, SALE & LEASES

The Turteltaub Law Firm represents Clients from the initial investigation of commercial properties through the negotiation of purchase and sale agreements and/or leases, the conduct of due diligence, securing financing, and closing. We provide legal and business guidance that inform our Clients of the issues and terms of the business deal so that they may make informed decisions.

COMMERCIAL REAL ESTATE LITIGATION

The Turteltaub Law Firm assists clients in resolving commercial real estate matters including disputes regarding title, encroachments, lease disputes, brokerage commissions, property taxation and other real estate related matters. In addressing these matters, we seek advantageous business resolutions and, if necessary, represent clients in litigations when an amicable resolution cannot be reached.
